Terms of Sale & Use

These terms apply when you use keepsake.gallery, order a Keepsake ornament, or view a Keepsake gallery. Keepsake is a business of Wonderwell Designs LLC. “Keepsake,” “we” and “us” mean Wonderwell Designs LLC, doing business as Keepsake. “You” means you. By placing an order or using the site, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the site.

1. Who can order

You must be at least 18 years old to place an order. We currently ship only to addresses in the United States.

2. The ornament

Each Keepsake ornament is made by hand to order. It includes a printed photo, a small NFC chip and a QR code that open the ornament’s online gallery. Because each piece is handmade, small variations in color, cropping and finish are normal. Previews on the site are close approximations, not exact proofs. Printed colors can differ from how they look on your screen.

Opening a gallery by tapping requires a phone with NFC turned on. Most recent iPhones and Android phones have it. Some phones, cases and settings may get in the way. Every ornament also has a QR code that works with any phone camera. Either way, you’ll need an internet connection.

3. Orders, prices and discount codes

All prices are in U.S. dollars and are shown before you pay, along with any shipping charge and applicable tax. We may change prices at any time, but changes won’t affect an order you’ve already paid for.
Multi-ornament pricing applies only when the ornaments are purchased together in a single order.
Discount codes have no cash value. They can’t be combined unless we say otherwise and may have limits on how often they can be used. We can end or change them at any time.
Your order is accepted once payment is complete and you receive our confirmation email. We may refuse or cancel an order with a full refund, for example if a price was displayed in error or an item can’t be made. Orders that violate these terms may be cancelled without a refund (see section 6).
Order another Keepsake. Additional ornaments for an existing gallery are 25% off the single-ornament price (or the 2-pack price, if that’s lower). To get the discount, order through “Order another Keepsake” in the gallery’s menu or the link in our thank-you email. An additional ornament has the same photo and opens the same gallery as the original. It doesn’t get a gallery of its own, so it shows any changes made to that gallery, such as its gift note, and if that gallery is deleted it will no longer open anything. The discount can’t be combined with discount codes and has no cash value. We may change or end this offer for future orders.
Payments are processed securely by Stripe.

4. Shipping

Orders ship by USPS Ground Advantage to the address you provide, so please double-check it. Delivery times are estimates, not guarantees, especially during the holiday season. Order early if you need your ornament by a particular date. We’ll email you tracking information once your order ships.

If your package is lost or arrives damaged, email us within 30 days of the estimated delivery date and we’ll replace it or refund you. We aren’t responsible for packages delivered to an incorrect address you provided.

5. Cancellations, returns and refunds

Cancelling. You can cancel your order any time until it’s marked shipped, using the link in your order confirmation email. We’ll refund you in full to your original payment method. Once your order has shipped, it can no longer be cancelled.
Returns. Because every ornament is a personalized product made with your own photos, we can’t accept returns or exchanges.
If something’s not right. Please let us know if your ornament arrives damaged or defective, the gallery doesn’t open, or you’re unhappy in any way, and we’ll do our best to make it right. For damage or defects, email us within 30 days of delivery, with a photo if you can, and we’ll replace it or refund you. You don’t need to send it back.
Refunds go back to your original payment method. Your bank may take several business days to show them.

6. Your photos

You keep all rights to the photos, title and gift message you upload (“your content”). You give us permission to store, copy, resize, crop, print and display your content only as needed to make, ship and support your ornament and host its gallery, including making any replacement prints. We won’t use your content for advertising or marketing without your permission.

When you upload content, you confirm that:

You own it or have permission to use it, and using it here doesn’t infringe anyone’s copyright, privacy or other rights.
The people shown in it would be comfortable having it printed and shared in the gallery.
It isn’t illegal, and doesn’t contain nudity or sexually explicit material, graphic violence, or hateful, abusive, harassing or threatening images or language, including in the title or gift message.
It doesn’t exploit, sexualize or endanger minors in any way.

We see your photos, title and gift message while making your ornament. We may refuse to print, or may remove, content that we believe violates these terms or the law. Orders that violate these terms may be cancelled without a refund.

If content you share with us appears to show evidence of a crime, abuse, or a risk of harm to someone, especially a child, we reserve the right to report it, along with your order information and content, to law enforcement or other appropriate authorities, and we will make any report the law requires.

7. Your gallery

Access. Your gallery is private by link: anyone with the ornament, its QR code or the gallery link can view it. There is no password, so share the link carefully. See our Privacy Policy for details, including optional share links.
Changes. Your photos and their order are set when you place your order, and they’re printed and loaded into the gallery as you arranged them. You can edit your gift message at any time from the link in your confirmation email.
How long it lasts. Galleries have no subscription and no expiration date. We intend to keep every gallery online for as long as Keepsake is in business. If we ever have to discontinue galleries, we’ll give at least 90 days’ notice to the email address on your order, along with a way to save your photos.
Availability. We work to keep galleries online at all times, but occasional outages and maintenance may happen.
Deletion. You can ask us to delete your gallery at any time. Deletion is permanent, and the ornament will no longer open anything.

8. Using the site

Please don’t misuse the site. That means no attempts to access other people’s orders or galleries without the link, no interfering with how the site works, no scraping, no reverse engineering, and no using the site for anything illegal. The Keepsake name, logo, designs, site and content (other than your content) belong to us. You may not use them without our permission.

9. Copyright complaints

If you believe something on a Keepsake gallery infringes your copyright, email info@keepsake.gallery with the gallery link, a description of the work, and your contact information. We’ll review it and remove infringing content where appropriate.

10. Disclaimers

Except as expressly stated in these terms, the site, galleries and products are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that every phone will read the NFC chip or that the site will always be uninterrupted or error-free. Some states don’t allow certain warranty exclusions, so some of these may not apply to you.

11. Limitation of liability

To the fullest extent allowed by law, Keepsake will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits, arising from your use of the site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some states don’t allow these limits, so they may not apply to you.

12. Indemnity

If someone brings a claim against us because of content you uploaded or your violation of these terms, you agree to cover our reasonable losses and costs, including attorneys’ fees, arising from that claim.

13. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. If you have a problem, please email us first. Most issues can be sorted out quickly. Any legal dispute that can’t be resolved informally will be brought in the state or federal courts located in Bucks County, Pennsylvania, and you and we agree to those courts’ jurisdiction. Either party may instead bring an individual claim in small claims court where eligible.

14. Changes and other terms

We may update these terms from time to time. The version in effect when you place an order applies to that order. If any part of these terms can’t be enforced, the rest still applies. Our not enforcing a term isn’t a waiver of it. These terms and our Privacy Policy are the entire agreement between you and us about the site and your order.
